Analysis of Impediments to Fair Housing

As a recipient of federal funds, the City of Bend is required by the U.S. Department of Housing and Urban Development (HUD) to sign a certification to affirmatively further fair housing. An Analysis of Impediments (AI) is the basis for fair housing planning activities and development of strategies to reduce impediments.

Fair housing means available and accessible housing exists in all neighborhoods free from housing discrimination or harassment for people to live where they would like to live. Actions that improve such housing choice in all areas of a neighborhood or all neighborhoods of a community break down housing market barriers to advance fair housing.

FAIR HOUSING LAWS

Historically, specific persons received unfavorable treatment when finding housing and living in housing. Such persons reported housing denials, harassment, less favorable terms and conditions, or lower-level services when they attempting to rent, buy, get a mortgage, or secure homeowners insurance. To address such treatment, also known as housing discrimination, federal and state fair housing laws provide housing protections based on race, color, national origin, religion, gender, familial status, disability, sexual orientation (including gender identity), marital status, survivors of domestic violence, and source of income.

Additionally, fair housing laws require advancing fair housing in housing policy and community development. Often housing policy focuses on affordability, but many factors beyond the property itself contribute to a home’s value. Such factors or opportunities include nearby schools, close-by parks, walkable sidewalks, access to quality utility services, reliable public transportation, and responsive services for health and safety. Data indicates these neighborhood-based opportunities are strong signals of its community members’ ability to obtain education and wealth. Access to housing choice in neighborhoods with opportunities is crucial to advance fair housing for persons that have historically experienced housing discrimination or harassment.
