The City of Bend will hold a public hearing before the Hearings Officer on Thursday, December 12, 2019, at 9:30 a.m. in the Council Chambers, 710 NW Wall Street, Bend.

REQUEST: A 50-lot subdivision on 8.22 acres zoned Residential Standard Density. The original application was denied by the Hearings Officer on procedural grounds relating to submittal requirements for tree preservation. The denial was appealed by the applicant and the Three Pines Ridge Homeowners Association. The City Council declined review of the appeal and the applicant appealed to the Land Use Board of Appeals (LUBA). The applicant requested that the City withdraw the decision from LUBA for reconsideration by the same Hearings Officer who issued the original decision. This request was granted by the City as some of the issues may be able to be addressed by reopening the record before the Hearings Officer to allow additional evidence and testimony limited to the issues raised in the appeals. The code sections related to the appeals are limited to the tree protection plan and tree inventory requirements in BDC 3.2.200.C, D. and H., the waiver of public improvement standards for the trail width in BDC 3.4.150, the request for a fence in BDC 3.2.500, and compliance with BDC 2.1.300.C-E, BDC 2.1.700.A, BDC 2.1.800.A.1, BDC 2.1.1100.A, and BDC 3.1.400.F.5-8 regarding future construction of individual homes (setbacks, height, lot coverage, driveways) .
