All Tenants shall secure insurance at their own expense and is subject to Landlord’s acceptance. General Liability Airport Premises AND Aircraft Liability Insurance in an amount NOT less than $1,000,000 million or $2,000,000 commercial, (per the terms of your lease), per occurrence and in the aggregate. The policy should include coverage for personal injury, bodily injury, and property damage. The policy should include the City of Bend (Landlord) as additional insured.

ALL sub-tenant are required to also provide a COI with the same requirements.

The City’s acceptance of a Certificate of Insurance (“COI”) does not constitute confirmation, verification, or approval that the tenant’s insurance policy meets the insurance requirements of the lease, nor does it indicate that adequate coverage is in place. The responsibility to obtain and maintain all required insurance coverage rests solely with the tenant. If the tenant’s insurance is insufficient, expired, non compliant, or otherwise inadequate, the tenant remains fully responsible for any loss, damage, or liability—whether caused by the tenant, the tenant’s aircraft, or any other person or property for which the tenant is deemed responsible—at no cost to the City. Acceptance of a COI thus shall not be construed as a waiver of the tenant’s obligations under the lease or as a transfer of liability to the City. It is the tenant’s sole responsibility to ensure that all required coverages are continuously maintained in the required amounts and forms.

Indemnification:

As set forth in the lease, Tenant shall indemnify, hold harmless and defend Landlord from any claim, loss or liability and against all costs arising out of or related to any activities of Tenant on the Premises, except to the extent that the claim, loss, liability or cost is the direct result of Landlord’s negligence or other wrongful act or omission.

It is your responsibility—not the City’s—to maintain proper coverage at all times.
